On Saturday, March 1, several important legislative changes came into effect. Here is a brief overview of the most significant ones:
1. Ban on the Sale of Unmarked E-Liquids and Nicotine Products
The Federal Law No. 537-FZ dated December 28, 2024, has phased in a ban on the sale of all unmarked products—starting with e-liquids and nicotine delivery systems (ENDS), followed by cigarettes, cigars, sticks, and tobacco-free mixtures. Later, this ban will extend to hookah, chewing, snuff, smoking, and pipe tobacco, as well as cigars, cigarillos, bidis, and kreteks. From March 1, the circulation of unmarked ENDS and e-liquids is prohibited. All relevant codes in the “Honest Sign” system were supposed to be canceled. Attempting to process a Universal Transfer Document (UTD) with these codes will also result in an error.The ban applies to any sale of unmarked ENDS and e-liquids, including distributors, wholesalers, and retail stores. If a seller tries to sell such products, they may face fines of up to 300,000 rubles for selling unmarked goods.
2. Amendments to the Technical Regulations on Non-Smoking Tobacco Products
Amendments to Federal Law No. 268-FZ came into effect on March 1. These changes introduce new restrictions on nicotine content in chewing and snuff tobacco. They also include a list of prohibited substances in the composition, a ban on flavorings, and several other requirements.
3.Ban on the Production of Snus and Nus
Previously, Federal Law No. 15-FZ prohibited the sale of snus, nus, and nicotine pouches. Now, Federal Law No. 203-FZ, which regulates state control, has added a ban on the production of snus and nus within Russia, eliminating any ambiguity.
4.Introduction of the Definition of Tobacco-Free Mixtures for Heating
Federal Law No. 542-FZ dated December 28, 2024, has added a definition for tobacco-free mixtures for heating in Article 2, including a detailed description of this category.
